Award City – Terms and Conditions.

1. Introduction
1.1 The following sets out the Terms and Conditions for Award City Limited (“Award City”), a company registered in the United Kingdom under the registration number 12784903 and registered address of Stanmore House 64 – 68 Blackburn Street, Radcliffe, Manchester, England, M26 2JS.
1.2 These Terms and Conditions apply in whole to all individuals and entities who use, interact with, make a purchase or simply visit our Site (https://www.awardcity.co.uk/). By visiting our Site, and/or placing an order, you agree to the applicability of these Terms and Conditions to the contract between you and Award City. For this reason, it is important that you take your time to read this document carefully.
1.3 Products and Services available on this site are for the UK residents only.

2. Description
2.1 Award City offers a range of Challenges and Competitions that aim to help you achieve your goals and be the best version of yourself. All you have to do is register an account with us, purchase the Challenge you wish to complete and we will send you motivation along the way as well as a medal when the Challenge is complete. For more information about how our Site operates please continue reading.

3. Age restrictions
3.1 Consumers may only purchase services through this Site if they at least 18 years of age. None of the services on this Site may be purchased by anyone under 18 years of age.

4. Your order
4.1 Creating an account
4.1.1 In order to purchase any of our products, participate in any of our Challenges and Competitions or engage in any other activities on our Site, it is necessary to create an account. In creating your account you must provide us with certain information including your full name, email address and shipping address. For more information about how we collect, process and store your personal data, please read our Privacy Policy.
4.2 When you place an order through our Site you will automatically be sent an email acknowledging your order. This email will also contain additional information regarding the product you have purchased.
4.3 After your order has been processed, you will receive emails regarding the Challenge you are participating in. These are to motivate you and to remind you of any deadlines.
4.4 We reserve the right to refuse any order made by a customer through our Site for any reason we may feel necessary.

5. Prices and payment
5.1 All prices for our products are displayed on our Site. All prices on our Site include UK VAT.
5.2 We must make you aware that the prices of our products may change from time to time however, these variations will not affect any order that have already been placed.
5.3 All payments must be made through one of the online payment methods available on our Site. For information regarding the Terms and Conditions or Privacy Policies of a selected payment option please visit their site directly.

6. Challenges
6.1 Only current Challenges are available to purchase through our Site.
6.2 When you purchase a Challenge, you must activate this Challenge within 1 year of purchase. You can activate your Challenge by clicking the start button in your account under “My Challenges”. Once the Challenge is activated, you will be given a specific time frame in which you must complete the Challenge in order to receive a medal. This time frame is usually 28 days.
6.3 After completing the Challenge you must notify us of completion within the time frame given. In order to notify us of competition you must go to your Award City account, click on “My Challenges” and click “I’ve Finished”. If you choose to, you can also submit evidence of your challenge, for example photographs. We may upload or post some of these photographs on our website and/or social media pages providing that you have given us permission to do so. Your medal will then be sent out to you within 10 working days using the postal address on your account..

7. Competitions
7.1 After you have purchased a Challenge, you may wish to enter one of our Competitions. These Competitions are held on a Challenge by Challenge basis and are not available for every Challenge that is available to purchase through our Site. Please note the associated Challenge must be completed before you can enter a Competition.
7.2 Please note that you must enter the Competition as an individual. We do not accept group Competition entries at this stage.
7.2 If you wish to enter one of our Competitions, you must inform us of your intention to enter the Competition by opting-in. You can do so via your account. You must then submit video/photograph evidence of you completing the Challenge before the deadline given for the specific Competition you wish to enter. This deadline will be displayed on our website and will be sent to you via email.
7.3 For more information on the ways in which you can submit your video/photograph evidence please see the below section titled “Submitting your evidence”.
7.4 Competition process
7.4.1 The process of entering a competition is as follows:
• Purchase a challenge through our Site;
• Complete the challenge within the specified time frame;
• Video/photograph yourself completing the challenge;
• Upload this evidence via your Award City account;
• Competition entries will then be posted on our Site;
• You are encouraged to share your entry on social media and send it to your family and friends, encouraging people to vote for you;
• The competition will be open to public vote;
• Entries with the most votes will be crowned winners; and
• Prizes will be awarded.

8. Submitting your evidence
8.1 All evidence must be submitted via the online portal. In order to access the online portal you must login to your account and go to “My Challenges”. Once you click “I’ve Finished” you will be prompted to upload your evidence.
8.2 In order for your submission to be accepted, it must be submitted in one of the following formats: MP4; MOV; AVI; or WMC. The file must be a maximum of 150MB and any video evidence must not exceed 30 seconds.
8.3 We recommend that all video submissions are filmed in landscape mode rather than portrait.
8.4 If for any reason the online portal is not working when you come to upload your evidence, please use the contact form to bring this to our attention (https://www.awardcity.co.uk/help/). We will try our best to get any issues resolved as soon as possible.
8.5 Under no circumstances should you submit evidence to us via email. Any emails containing Competition entries will be deleted and will not be entered into the Competition.

9. Competition entry requirements
9.1 In order to enter one of our Competitions, you must either be aged 18 and older, or be entered by your parent and/or legal guardian.
9.2 If you are below the age of 18 and wish to enter, the account used to enter must be set up in the name of your parent and/or legal guardian. This means that all of the information relating to the account must be that of the parent and/or legal guardian rather than the minor. Anyone aged 18 or above who is entering a minor into a competition will be asked to confirm whether they are the parent and/or legal guardian of the minor.
9.3 Any video/photographic evidence submitted should not include any personal information about the minor, i.e. name, date of birth, etc, other than what is displayed in the video/photograph.
9.4 Video and photographic evidence should limit as much as possible the amount of personal data related to the minor for the minor’s protection.
9.5 Award City reserves the right to remove or refuse to enter video or photographic evidence into a competition if they believe it would be potentially harmful to the minor and not in their best interest.

10. Competition winners
10.1 Competition winners are chosen solely through public vote. Award City does not participate in choosing the winners of any of its Competitions.
10.2 The number of Competition winners may vary from Competition to Competition. This will depend on a number of factors including but not limited to the type of Competition, the number of rounds the Competition has and how many people enter that specific Competition.
10.3 The specific number of Competition winners and the number of prizes given for each Competition will be detailed in the description of each individual Competition.

11. Disclaimers
11.1 Award City endeavors to ensure that all Challenges and Competitions available and conducted through its Site are safe and appropriate. However, any user participating in a Challenge or Competition, or entering a minor in a Challenge or Competition, is solely responsible for insuring that the participant has the requisite skill and competency to participate and can do so without causing themselves or others harm or injury. If participants suffer from any medical conditions it is strongly recommended that they seek the advice of a medical professional before participating in any Challenge or Competition.
11.2 Award City can neither assume nor accept responsibility for any costs incurred, damages or injuries suffered, or any other loss resulting from participation in one of its Challenges or Competitions. Nothing in these Terms and Conditions seeks to exclude or limit Award City’s liability for death or personal injury caused by Award City’s gross negligence (including actions taken by employees, agents or subcontractors); or for fraud or fraudulent misrepresentation.

12. Voting
12.1 Award City makes every effort to ensure that votes for Competition participants are fair and representative of the talents and skills of the participants. In furtherance of this, and in accordance with applicable law, Award City provides voting opportunities in the following manner:
12.2 Registered account
12.2.1 All individuals who wish to vote in a competition must register and create an account with Award City. They can do so by following this link (https://www.awardcity.co.uk/register/). Individuals may only register for one account.
12.2.2 Any individual found to be registered to vote under more than one account may have all accounts deactivated and their right to vote in any further Award City Competitions permanently revoked.
12.3 Free votes
12.3.1 Each registered account user is entitled to 3 free votes per month. These allocated votes can be used on any of our Competition’s.
12.3.2 Any unused votes will be rolled over to the following month.
12.4 Additional votes
12.4.1 Any individual with a registered account who has already voted 3 times in any month may choose to cast additional votes but must pay a fee for each additional vote. For information and access to paid vote casting please follow this link (https://www.awardcity.co.uk/voting/).

13. Prizes
13.1 Prizes are awarded at each stage of a competition to winners. Winners are determined solely through public voting. Those receiving the most votes are the winners.
13.2 Award City will decide at its sole discretion what the prizes will be for each Competition. However, it is always the goal to provide prizes that are appropriate in recognising the skill and talent of the competition winners. In addition, where winners are under the age of 18 prizes will be awarded that are age appropriate.
13.3 The value of each prize may vary depending the Competition and the availability of certain prizes.
13.4 Where applicable a winner may be required to make accommodations to collect a prize. This may include arranging for and paying their own transportation costs where a prize is a visit to a specific venue or to meet a celebrity.

14. Cancellations and refunds
14.1 In accordance with governing law some online purchases will be eligible for cancellation and a full refund.. However, there are limitations when cancellation is applicable and in any event the cancellation must occur within 14 days of purchase.

15. Links to other Sites
15.1 Links to other sites may be included on our Site. Unless expressly stated, these sites are not under Award City’s control. Award City neither assumes nor accepts responsibility or liability for the content of third-party sites. This inclusion of a link to another Site is for information only and does not imply any endorsement of the sites themselves or of those in control of them.

16. Acceptable use policy
16.1 This Site must only be used in compliance with these Terms and Conditions. You must not use this Site in a manner that is unlawful or fraudulent. You must not knowingly cause harm to the Site by uploading, sending or in any other way transmitting data that contains any form of virus or malware or any other code designed to adversely affect computer, hardware, software, or data of any kind. You must not knowingly cause any harm to any other user to our Site.

17. Changes to these Terms and Conditions
17.1 Award City may alter these Terms and Conditions at any time. If Award City decides to do this, any such changes will become binding on all visitors when using and/or browsing our Site. All visitors are therefore advised to check this page and read out Terms and Conditions upon every visit to our Site.

18. Data protection, privacy and cookies
18.1 These Terms and Conditions have been drafted in line and in accordance with the Data Protection Act 2018.
18.2 Use of this Site is governed by our Privacy Policy and Cookie Policy which can be found here (insert links). These polices are incorporated into these Terms and Conditions by this reference.

19. Severability and waiver
19.1 If any provisions of these Terms and Conditions are found to be unlawful, invalid or otherwise unenforceable by any court or other authority, these provisions shall be deemed severed from the remainder of these Terms and Conditions. The remainder of these Terms and Conditions shall be valid and enforceable.

20. Law and jurisdiction
20.1 These Terms and Conditions, and the relationship between Award City and customers or visitors of our Site (whether contractual or otherwise) shall be governed by, and construed in accordance with, the law of England and Wales.
20.2 Any disputes concerning these Terms and Conditions, the relationship between customers, visitors and Award City, or any matters arising therefrom or associate therewith (whether contractual or otherwise) shall be subject to the jurisdiction of the court of England and Wales.
